Welcome to SwingSwap! These Terms of Service ("Terms") govern your access to and use of SwingSwap's services, including our website, mobile applications, and related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

1. Eligibility

1.1 Age Requirement

YOU MUST BE AT LEAST 18 YEARS OLD TO USE SWINGSWAP. By creating an account, you represent and warrant that you are 18 years of age or older.

7A. Zero-Tolerance Violations & Criminal Conduct

The following behaviors result in IMMEDIATE PERMANENT BAN and MANDATORY LAW ENFORCEMENT REFERRAL.

7A.1 Non-Consensual Intimate Imagery (NCII / "Revenge Porn")

THIS IS A CRIME IN MOST JURISDICTIONS UNDER STATE AND FEDERAL LAW.

You must NEVER:

  • Share intimate images or videos of any person without their explicit, documented consent
  • Threaten to share intimate content as leverage, coercion, or revenge
  • Screenshot or record video calls without all participants' consent
  • Share content from private albums or vault areas without permission
  • Distribute content beyond the originally agreed context

Immediate Consequences:

  1. Permanent Ban: Immediate and irrevocable termination of your SwingSwap account
  2. Associated Accounts: All accounts linked by IP, device, payment method, or identity terminated
  3. Evidence Preservation: All relevant data, logs, IP addresses, and content preserved for investigation
  4. Mandatory Law Enforcement Referral: We will report to local law enforcement, FBI IC3, NCMEC (if applicable), and relevant state Attorney General offices

7A.2 Sexual Assault & Coercion

ANY form of sexual contact without enthusiastic consent is a crime. Zero-tolerance violations include any sexual contact without explicit consent, coercing or manipulating someone into sexual activity, ignoring safe words or withdrawal of consent, and "stealthing" (removing protection without consent).

7A.3 Harassment, Stalking & Threats

Zero-tolerance for continued contact after being told to stop, creating multiple accounts to evade blocks, following someone to other platforms or real-life locations, threats of violence or intimidation, blackmail or extortion, and doxxing.

7B. Consent Standards

All interactions on and off SwingSwap must be consensual:

  • Enthusiastic consent is required for all interactions
  • "No" means no — no exceptions, no negotiations
  • Silence is not consent — if someone hasn't explicitly said yes, assume no
  • Consent can be withdrawn at any time — respect it immediately
  • Intoxication negates consent — neither for you nor others

7C. Law Enforcement Cooperation

SwingSwap maintains a cooperative relationship with law enforcement while protecting user privacy to the extent legally permitted. We will disclose information in response to valid legal process, to report suspected child exploitation, when we believe disclosure is necessary to prevent imminent harm, and to report criminal activity on our platform.
